Terms of Service

1. The service

Human Memory Cloud is designed as a secure digital extension of human memory: a place to intentionally preserve stories, reflections, life experiences, wisdom, photos, videos, audio recordings, documents and other meaningful materials.

2. Accounts

• You must provide a valid email address you control, or sign in with a Google account you own.
• You are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you suspect unauthorised access.
• You must be at least 13 years old to create an account. If you are under 18, you must have permission from a parent or legal guardian.
• One account is for one person. Do not create accounts for others without their authority.

3. Your content and ownership

You retain ownership of the original memories, stories, files and other content you upload (“Your Content”). We do not claim ownership of it.

You grant DrexPoint Limited a limited, non-exclusive licence to store, process, back up, display to you and transmit Your Content only as needed to operate, secure and provide the service to you. This licence ends when Your Content is deleted, except for residual copies in backups for a limited period, as described in the Privacy Policy.

This licence does not include using Your Content to train AI models, generate AI responses, create a voice model or share it with anyone. Those uses would require the separate permissions described in section 7.

4. Your responsibility for content and third parties

You are responsible for the content you upload. Memories often involve other people. Having a photo, recording or letter does not automatically mean you own the rights to another person’s image, voice, likeness, writing or private information.

• Only upload content you have the right to store.
• Take care with material about children, family members, friends and other identifiable people, and respect their privacy.
• Do not upload third-party copyrighted material unless you own it, have permission, or the law allows it.
• Do not upload recordings of others made unlawfully.

5. Acceptable use and prohibited content

You must not use Human Memory Cloud to:

• store or share unlawful content, including child sexual abuse material;
• harass, threaten, defame, impersonate or deceive anyone;
• infringe intellectual-property, privacy or publicity rights;
• upload malware or attempt to access other users’ accounts, memories or files;
• probe, overload or bypass the security of the service;
• (in future) create or attempt to create a voice model, likeness or AI legacy of another person without their verified authorisation, or use generated output for fraud, impersonation or unauthorised commercial purposes.

6. AI-generated content limitations (planned)

• AI responses will be generated from materials the original user specifically authorised, and will be clearly labelled as AI-generated.
• The AI will not claim to be the original person, to be conscious, or to know with certainty what that person would have said. It may say, for example: “Based on the memories, stories and advice your grandfather preserved, he may have encouraged you to…” — never “I am your grandfather.”
• AI output may be incomplete or wrong. It is not professional, financial, legal, medical or psychological advice, and you should use your own judgement.
• Human Memory Cloud does not bring anyone back to life. Its purpose is to preserve and responsibly communicate recorded wisdom, memories and values.

7. Separate permissions and consent

Human Memory Cloud treats the following as four separate permissions. None of them automatically implies another:

• Memory storage — saving content in your private vault (the only permission used today).
• AI use — allowing selected memories to be used for AI-assisted responses. Saving a memory never authorises AI processing.
• Voice generation — allowing an AI-generated version of your recorded voice. Uploading audio never authorises voice cloning, and allowing AI use never authorises synthetic voice.
• Legacy access — allowing named people to access your digital legacy. Creating a legacy never makes it accessible to everyone.

Future permissions will require explicit, opt-in consent that is never pre-selected, and you will be able to change or revoke each one independently.

10. Service availability and changes

We work to keep the service available and secure but do not guarantee uninterrupted or error-free operation. We recommend keeping your own copies of irreplaceable originals. We may change, add or remove features, and will aim to give reasonable notice of significant changes.

11. Suspension, termination and deletion

You may stop using the service at any time. We may suspend or terminate accounts that breach these Terms or put others at risk. You may request deletion of your account and content by emailing Nwosusamson2009@gmail.com; we will delete it within 14 days of your request. Deleting a memory in the vault removes it and its attached files. Details on retention are in the Privacy Policy.

12. Intellectual property

The Human Memory Cloud name, logo, software and site design belong to DrexPoint Limited or its licensors. These Terms do not grant you rights to them other than to use the service.

13. Limitation of liability

To the extent permitted by applicable law, the service is provided “as is”, and DrexPoint Limited is not liable for indirect or consequential losses, or for loss of content beyond what the law requires. Nothing in these Terms limits liability that cannot be limited by law.

14. Changes to these Terms

We may update these Terms. We will change the “Last updated” date and, for material changes, notify you in the app or by email before they take effect.
